Demnach gelten die Anforderungen, die in einem Gerichtsverfahren zum Nachweis der orts\u00fcblichen Vergleichsmiete an ein Sachverst\u00e4ndigengutachten als Beweismittel zu stellen sind, nicht f\u00fcr die Begr\u00fcndung eines Mieterh\u00f6hungsbegehrens unter Bezugnahme eines Sachverst\u00e4ndigengutachtens gem. \u00a7 558a Abs. 2 Nr. 3 BGB \u2013 BGH, Urteil vom 03.
